Dissecting a Court Ruling

The news release started with this paragraph.  "A saga over 15 years in the making has ended well for common sense and dune riding access. The U.S. Ninth Circuit Court of Appeals today rejected appeals from the Center for Biological Diversity (CBD), and upheld the Bureau of Land Management’s (BLM) 2013 Imperial Sand Dunes Recreation Area (ISDRA) management plan. The Plan restored motorized dune vehicle access to most of the ISDRA areas closed on an “interim” basis in a 2001 settlement agreement. After nearly a decade of study and planning, BLM determined these areas were appropriate for dune vehicle riding."

Is the clock ticking?

Much is said today about recreation and the changing lifestyle of people that allows more freedom for leisure time activities. During their leisure time, people have the freedom to engage in a variety of activities and outdoor recreation is very popular. Some recreationists are informed and experienced; others are uninformed and inexperienced.

When I use the term "uninformed recreationist", I am referring to the guy that is gung-ho on going anywhere at anytime without a care in the world for what he is doing. Someone that has the attitude that they "own" the land and their rights comes first, above all.

NEPA - The Basics

The National Environmental Policy Act (NEPA) assures that federal agencies will consider the impact of an action on the human environment before decisions are made and the action is taken. It requires that NEPA documents concentrate on issues that are significant to the action in question. The NEPA process is intended to help public officials make better decisions based on an understanding of environmental consequences, and take actions that protect, restore, and enhance the human environment.

What NEPA is and is not...

Adaptive Management and the WQMH

Adaptive management is used where decisions can be made and actions modified during the project duration and a level of experimentation can be applied to achieve the desired goal.

You begin with a clear goal and an uncertain means to accomplish that goal.  You “adapt” your work steps as conditions change to complete your goal.  While adaptive management provides flexibility to change the active steps, it is highly dependent on monitoring, accuracy of data, and analysis of data.
